SELF TOW AND SITE DROP OFF TOURING CARAVAN TERMS AND CONDITIONS

This agreement is between Bay Motorhomes and the Hirer (you).

1. RESERVATION DETAILS
                                                                                                                            
To secure a booking Bay Motorhomes require a deposit of £250.  Balance of the hire cost is due 6 weeks prior to departure date.  In addition to this we take a bond of £300 14 days before departure date which is refundable to you 14 days after returning the caravan, following inspection for any small damage or loss of equipment.  In all cases a confirmation of booking will be sent out to the hirer.

2. DRIVERS


(a) Drivers must be over 21 and under 70 years of age and have held a UK driving license for at least two years. Proof of identity must be produced by all drivers/ hirers at the time of pick up, the following will be required:
2 current utility bills at present address.
A valid driving license.  
Car insurance to include towing.
Car breakdown cover document to include caravan.
Alco tow ball with standard 7pin trailer electrics.
Towing mirrors.
Occupation of all drivers.

3. INSURANCE

Any caravan hired under this agreement may only be towed by the hirer/driver who has been accepted by bay motorhomes and their insurance company. Caravans are for UK hire only.
Even though it may be covered by Bay Motorhomes insurance policy, the hirer will be liable to pay the cost of repair of any damage which the caravan may suffer as the result of the wilful action of the hirer.
It is important that you are aware that there is a £1000 EXCESS payable for any damages or loss for any one incident or accident whilst the caravan is on hire to you or in your care. The hirer will compensate Bay Motorhomes for any loss which it may suffer as a result of any act or omission on the part of the Hirer or his servant or agent.
Excluded from insurance cover is:-
1) Windscreen, all other glass and tyres.
2) Loss/damage/theft to the radio, stereo equipment, and Aerial's.
3) Interior damage including burns to seats, carpets, and other damage.
4) Vandalism damage of any kind to the caravan.
5) Personal effects within or from the caravan.
6) Negligence of any kind.

3A. THEFT OF/FROM CARAVAN

It is extremely important that you are aware the hirer is totally responsible for the security of the caravan. You must ensure if the caravan is left unattended at any time that it is securely locked, hitch lock fitted, wheel lock fitted and parked in a safe well lit location. Theft from and theft of caravans is very high risk therefore the hirer must take every precaution to protect the caravan. Do not leave the caravan in a vulnerable location or unlocked at any time, always remember total liability is with the hirer if you do not adhere to the above.

4. EUROPEAN TRAVELS

No European travel available at this time.

5. BREAKDOWN


(a) In the event of a breakdown Bay Motorhomes should be notified immediately by the hirer. The hirer’s breakdown policy will cover the caravan also.
(b) The hirer is authorised to spend up to £50 on repairs which will be repaid to them on the presentation of valid receipts.  Bay Motorhomes approval must be obtained in respect of repairs or replacement in excess of £50.
(c) Bay Motorhomes will not be responsible for any consequential loss or expense subsequent to a breakdown, and will not be under any liability for third party claims for damages.
(d) We will try to provide a replacement caravan if available, however if this is not possible and the hire of the vehicle is terminated early due to a breakdown we will only be responsible for the period of time lost and a pro-rata refund made.
(e) Every effort is made to ensure that all our caravan’s are in a safe and road worthy condition before they leave our premises, but Bay Motorhomes shall be under no liability for third party claims or damages in connection with any breakdown (or accident).
(f) Any breakdown or fault caused by negligence of the hirer or driver shall be made good at their own expense.

6. ACCIDENTS


(a) In the event of an accident Bay Motorhomes should be notified immediately by the hirer.  A complete accident report must be made out and handed to us at the end of your hire period.
(b) In the event of an accident please make sure you obtain all names/addresses/vehicle information of all third parties and their insurance details.  Also any witness details if applicable.  Do not admit liability.
(c) Bay Motorhomes will not be responsible for any consequential loss or expense subsequent to an accident, and will not be under any liability for third party claims or damages.
(d) In the event of the caravan being unsafe to use after an accident, whether it the hirer’s or a third party fault, under any circumstances, there will be no replacement caravan provided and no refund will be given on your hire monies.

7. COLLECTION AND RETURN

(a) Caravan hire is from Friday to Friday (unless otherwise agreed) and caravans are available for collection between 3.00pm and 5.00pm and must be returned between 9.00 and 10.00a.m. Unless otherwise arranged in writing. Failing to comply with these times will result in the Hirer being surcharged at the rate of £50 per hour or any part thereof. (First 3 hours) and balance of deposit thereafter together with any additional costs incurred by Bay Motorhomes.
(b) No refund is given for an early return of the caravan.
(c) The Hirer acknowledges delivery of the caravan and the contents free from any defect or damage and complete other than as specified by Bay Motorhomes at the date of commencement of hire and are therefore advised to check the caravan thoroughly before leaving.
(d) Upon return a Bay Motorhomes representative will check the caravan for damage, cleanliness, etc., including the condition of the tyres and windows which are not included in the Bay Motorhomes insurance policy, any such damage is the Hirer's responsibility (see condition 1)

8. CANCELLATIONS


(a) Cancellations must be in writing and are charged as follows:
More than 6 weeks prior to commencement of hire -Loss of deposit.
Between 4 and 6 weeks – 50% of hire cost.
Less than 4 weeks prior to commencement of hire –100% of hire cost
(b) Bay Motorhomes reserves the right to cancel the hire if at the commencement of the hire the driver's licence, car insurance, mot, breakdown policy details are deemed invalid or not in accordance with the conditions set out in condition (2) and if Bay Motorhomes deems the tow car to be unsuitable to tow our caravans safely. In these circumstances the total hire charge will be forfeited.
(c) Hirers are strongly advised to insure against unavoidable cancellation.

9. GAS

Two gas cylinders are provided at the time of hire; at least one will be full of gas. The cost of any refills thereafter will be borne by the company.  Upon presentation of a valid receipt Bay Motorhomes will refund the full cost of any gas purchased during the hire.

10. AVAILABILITY

Whilst every effort is made to ensure that the caravan reserved is available. If due to circumstances beyond Bay Motorhomes control, the reserved caravan is not available Bay Motorhomes reserves the right to offer a suitable alternative. If this is not available or acceptable the liability of Bay Motorhomes will be limited to the refund of any monies paid by the Hirer.

11. LIABILITIES


(a) The Hirer shall be responsible for all damage to windscreen, tyres, punctures and all costs and expenses included as a result of offences against the Road Traffic Acts and/or regulations there under, and indemnifies Bay Motorhomes from any liability.
(b) The hirer shall not let the caravan be towed at a greater speed than 60mph.
(c) The hirer is required to keep the caravan under their control throughout the period of hire. When unattended it must be locked, hitch lock fitted and wheel lock fitted at all times.
(d) The hirer is required to check tyre pressures as specified in the vehicle manual.
(e) The hirer or named driver at the time of hire shall only be permitted to tow the caravan.
(f) The hirer will not lend, hire or lease the caravan or any of its equipment to a third party.
(g) The hirer will ensure the caravan number plate is on and visible and matches the registration of the towing vehicle at all times

14. HOLIDAY INSURANCE
                                                                                                                        
The hirer is responsible for booking their own holiday insurance.

15. TOWING RULES

The towing weights of the hirer’s car must be in accordance with their vehicles manufactures specifications and not to overload Bay Motorhomes caravan’s in accordance with its manufacturers specifications. There are also weight ratio’s supplied by the specialized caravan’s club’s that will apply (ask for details). Drivers who passed their test after 1996 may be restricted on the weight of the trailer they are permitted to tow (ask for details).

16. COMPANY RIGHTS
                                                                                                                                              
Bay Motorhomes reserves the right to vary rates and conditions at any time.
